Terms and Conditions

These Terms and Conditions govern the relationship between Best Energy Ltd ("Best.Energy", "we", "us", or "our"), individual Affiliates ("Affiliates", "you", or "your") and Best.Energy Global Partners (“Partners”) participating in our Affiliate Programme ("Programme").
By registering as an Affiliate and participating in the Programme, you agree to be bound by these Terms and Conditions.
Affiliate Registration & Status
To become an Affiliate, you must complete the registration process on our Affiliate Hub located at https://best.energy/affiliate-hub and have an active subscription on the program. By registering, you confirm that you have read, understood, and agree to abide by these Terms and Conditions.
Failure to maintain an active subscription will render your Affiliate status null and void. You cannot receive Compensation for leads generated if you do not have an active subscription, regardless of whether the lead was submitted before or after the lapsing of your subscription status.
Affiliate Responsibilities & Permissions
- As an Affiliate, you agree to promote Best.Energy's products and services to potential clients within your local region.
- You are responsible for generating leads by referring potential clients to Best.Energy through the Affiliate Hub.
- Leads must be registered using the Affiliate form provided in the Affiliate Hub, including full details of the client prospect.
- You are not permitted to trade as, appear as or claim to be Best.Energy or any variation thereupon. In all activities as a Best.Energy Affiliate, you are acting as an independent entity.
- Similarly, it is understood that Affiliate status does not constitute full Partner status. This Agreement does not permit you to operate as a Partner, distribute Best.Energy products, use Best.Energy services or otherwise benefit from the unique features of a Best.Energy Partnership.
Affiliate Certification
- All official Affiliates must have completed the 'Best.Energy Affiliate Programme' course on the Learning Management System (LMS), passed the examination, and received their official certificate.
Lead Generation and Compensation
- A lead is defined as a client prospect registered with full details on the Affiliate form in the Affiliate Hub.
- When a lead provided by an Affiliate turns into a paying client for Best.Energy or a Best.Energy Global Partner, the relevant Partner for the territory of the client is obligated to provide the Affiliate with 5% of the project revenue generated from that lead. Payment shall be made within 14 days of cash banked against that deal, by the Partner. No payment shall be made before cash is received.
- The compensation percentage stated shall be net of any relevant sales tax (eg. VAT).
- The compensation percentage shall apply only to cash banked. It is expected that this will be largely payable on installation, in line with the majority of asset lending funding arrangements. However, where the deal is self-financed, or otherwise, and the client is paying monthly, or monies from the project are otherwise being received in instalments – the compensation percentage shall be payable in line with those instalments during the full project length, against monies banked. There shall be no claim available by the Affiliate in the event of early termination by the client.
- The compensation percentage applies only to hardware sales and installation time, it does not apply to the value of software or service.
Partner Obligations
- Partners within the Best.Energy Global Partner Network are obligated to honour the compensation commitment outlined in Section 5 upon successful conversion of a lead into a paying client.
- Partners must provide timely and accurate reporting of revenue generated from leads provided by Affiliates.
Intellectual Property
- Affiliates may use promotional materials provided by Best.Energy for the purpose of promoting products and services only within the scope of the Programme.
- Affiliates agree not to modify, reproduce, or distribute Best.Energy's intellectual property without prior written consent.
Termination
- Best.Energy reserves the right to terminate an Affiliate's participation in the Programme at any time without prior notice for any breach of these Terms and Conditions or for any other reason deemed appropriate.
Amendments
- Best.Energy reserves the right to amend these Terms and Conditions at any time without prior notice. Affiliates will be notified of any changes, and continued participation in the Programme after such changes constitute acceptance of the amended Terms and Conditions.
Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England & Wales. Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England & Wales.
By registering as an Affiliate and participating in the Programme, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions in their entirety. If you do not agree to these Terms and Conditions, you may not participate in the Programme.
